These Terms of Service ("Terms") govern your access to and use of the EVUNITY mobile app, website, prepaid wallet and charging network (together, the "Services"). EVUNITY is an open EV charging network that lets drivers find, start and pay for charging, and lets hosts list and manage their chargers. Please read these Terms carefully, because they include important limitations on liability and warranties.
By creating an account, downloading the app or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
1. Acceptance of these terms
By accessing or using the Services you confirm that you have read, understood and agree to be bound by these Terms and any policies referenced in them. These Terms form a binding agreement between you and EVUNITY. We may provide additional terms for specific features, and those apply in addition to these Terms.
2. Eligibility
You must be at least 18 years old, or the age of majority in your market, and able to enter into a binding contract to use the Services. You agree to provide accurate and complete information when you register and to keep it up to date. If you use the Services on behalf of a business, you confirm you are authorised to bind that business to these Terms.
3. The Services
EVUNITY connects drivers with charge points operated by hosts and roaming partners. We provide the software, wallet and network that make a charge possible, but the electricity, the physical charger and its availability are provided by the host or operator. Charger availability, speed and condition can vary and are not guaranteed by EVUNITY.
4. Your account
You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately if you believe your account has been accessed without your permission. We may suspend or restrict accounts that appear compromised, fraudulent or in breach of these Terms.
5. Wallet, top ups, payments & refunds
EVUNITY uses a prepaid wallet. You top up your balance in advance, and the cost of each charging session is deducted from that balance. Top ups are processed by our payment partners, and you agree to provide accurate, current payment information.
- Your wallet balance is held in your local currency and can be used across EVUNITY and supported roaming partner sessions.
- The wallet's budget guard may end a session before your balance reaches zero to prevent it going negative.
- Wallet balances are not a deposit, do not earn interest and are intended for use on the Services.
- All wallet top ups, payments and charging sessions are final and non-refundable.
No refunds. All payments to EVUNITY, including wallet top ups and charges for charging sessions, are final and non-refundable. We do not provide refunds, credits or exchanges for unused wallet balance, partially used balance, or completed charging sessions, except where a refund is required by mandatory applicable law. Where a refund is legally required, we will process it to your wallet or your original payment method.
6. Charging sessions & pricing
The price of a charging session is set by the host (or roaming partner) and shown on the charger detail page before you start. You pay only for the energy delivered to your vehicle at that price, plus any fees disclosed before you begin. Session data such as energy delivered, duration and price is recorded in your charging history. You are responsible for using chargers safely and following any instructions shown at the charger.
7. Hosts & listing chargers
If you list a charger as a host, you are responsible for the charger's safety, compliance, accurate details and the pricing you set. You confirm that you have the right to make the charger available and to sell the electricity it delivers. EVUNITY provides the platform that manages sessions and settlement; platform and payment processing fees are confirmed during onboarding. You remain responsible for any taxes, permits and local regulations that apply to operating your charger.
8. Roaming & partner networks
Where roaming is available, you can charge on partner networks through open standards such as OCPI. When you do, the partner's pricing and conditions apply to that session, while billing is settled through your EVUNITY wallet and shown in one history. EVUNITY is not responsible for the operation or availability of partner chargers.
9. Acceptable use
When using the Services, you agree not to:
- Use the Services for any unlawful, fraudulent or harmful purpose.
- Interfere with, disrupt or attempt to gain unauthorised access to the Services, chargers or other users' accounts.
- Tamper with chargers, metering or any safety mechanism.
- Use bots, scrapers or automated means to access the Services except as we expressly permit.
- Resell, misrepresent or misuse the Services, or infringe the rights of EVUNITY, hosts or other users.
10. Additional features
From time to time we may offer additional features, such as vehicle connectivity, a marketplace or community features. Where and when these are available, additional terms may apply and will be presented to you before you use them. Some features described in our materials are planned or in development and may not be available in every market.
11. Intellectual property
EVUNITY and its licensors own all rights in the Services, including the software, design, logos, trademarks and content, except for content you provide. We grant you a limited, revocable licence that you may not transfer or sublicense, to use the Services for their intended purpose. You may not copy, modify, distribute or create derivative works from the Services without our permission. Any feedback you send us may be used without restriction or obligation to you.
12. Third party services
The Services rely on, and may link to, third parties such as payment processors, vehicle connectivity providers, hosts and roaming partners. Those services are governed by their own terms, and EVUNITY is not responsible for third party content, products or actions. Your use of a third party service is at your own risk.
13. Service availability & changes
We work to keep the Services available and reliable, but we do not guarantee they will be uninterrupted or error free. We may add, change, suspend or remove features, chargers or markets at any time, and we may carry out maintenance that temporarily limits access. Where reasonable, we will give notice of significant changes.
14. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and noninfringement. EVUNITY does not warrant that any charger will be available, compatible with your vehicle, or deliver a particular speed or outcome. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Limitation of liability
To the fullest extent permitted by law, EVUNITY will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the relevant service in the three months before the claim, or the equivalent amount permitted by applicable law. This does not limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.
16. Indemnification
You agree to indemnify and hold harmless EVUNITY and its officers, employees and partners from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Services, your breach of these Terms, or your violation of any law or the rights of a third party.
17. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or where we are required to by law. On termination, the provisions that by their nature should survive, including intellectual property, disclaimers, limitation of liability and indemnification, will continue to apply. We will handle any remaining wallet balance in line with applicable law.
18. Governing law & disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict of law rules, and you agree to the exclusive jurisdiction of the competent courts of Giza, Egypt, except where mandatory local consumer protection law gives you additional rights. Where required, this does not affect your right to bring proceedings in your country of residence.
19. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date above and, where appropriate, notify you in the app or by email. Your continued use of the Services after the changes take effect means you accept the updated Terms.
